These Terms and Conditions govern the rights and obligations between the seller and the buyer in connection with the sale of goods through the online store www.ignisshop.com in accordance with the Civil Code of the Czech Republic, EU Directive 2011/83/EU and related European Union legislation.

For customers outside the EU/EEA, contractual relations are governed by Czech law, without prejudice to mandatory consumer rights applicable in the buyer’s country of residence. Any customs duties, taxes, import fees or similar charges outside the EU/EEA shall be borne by the buyer.

2 Definitions

Seller – Daniel Vlček.
Consumer Buyer – a natural person acting outside the scope of their business activity or profession.
Business Buyer – a person acting within the scope of their business activity or profession.
Contract – a purchase contract concluded remotely through the online store.

3 Orders and Conclusion of Contract

By submitting an order, the buyer confirms that they have read and agreed to these Terms and Conditions, the Complaints Procedure and the Privacy Policy.

The purchase contract is concluded upon confirmation of the order by the seller via e-mail. The seller reserves the right to request additional order verification, especially for custom-made products, expensive orders or orders with unusual specifications.

All listed prices are final. Should the seller become VAT registered in the future, prices will be displayed including VAT in accordance with applicable law.

Ownership of the goods passes to the buyer upon full payment and acceptance of the goods.

4 Payment Terms

The following payment methods are available:

  • PayPal / credit card via PayPal,
  • bank transfer in advance – Fio banka, account number 5668978036/5500,
  • cash on delivery – if available in the destination country,
  • cash payment upon personal collection.

Unless agreed otherwise, the purchase price is due within 5 working days from the conclusion of the contract. In case of delayed payment, the seller reserves the right to cancel the order.

5 Delivery Terms

Not all products are permanently in stock. Delivery times for custom-made or individually modified products are specified on the product page or agreed individually with the buyer.

In-stock goods are usually dispatched within 2 working days after conclusion of the contract and receipt of payment, unless stated otherwise.

After dispatch, the buyer will receive tracking information if provided by the carrier.

Inspection of Shipment Upon Delivery

The buyer is required to inspect the condition of the package upon delivery. In case of visible damage to the package, we recommend refusing the shipment or immediately reporting the damage with the carrier.

Damage caused during transport must be reported to both the carrier and the seller without undue delay, ideally within 24 hours of delivery, including photographs of the packaging and damaged goods.

6 Consumer Right of Withdrawal / Returns

Consumers have the right to withdraw from a distance purchase contract without giving any reason within 14 days from receiving the goods.

To exercise the right of withdrawal, the consumer may use the online “Returns” form available on the seller’s website or contact the seller via e-mail at info@ignisshop.com.

The online form allows in particular:

  • identification of the order,
  • selection of specific items from the order,
  • selection of the request type,
  • electronic submission of withdrawal or return requests.

After submission of the form, the buyer will receive confirmation of receipt of the request without undue delay in text form via e-mail.

The withdrawal period is preserved if the notice of withdrawal is sent before the 14-day period expires.

The buyer bears the direct costs of returning the goods unless stated otherwise.

The seller shall refund all payments received from the buyer, including delivery costs corresponding to the cheapest offered delivery method, no later than 14 days after withdrawal from the contract. However, the seller is not obliged to refund the payment before receiving the returned goods or proof that the goods have been sent back.

The buyer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply in particular to:

  • custom-made goods,
  • goods modified according to the buyer’s wishes,
  • made-to-order products,
  • other cases listed in Section 1837 of the Czech Civil Code.

Custom-made or made-to-order products include in particular individually manufactured products such as custom Cyr Wheels, products modified according to customer requirements, individually configured products or other products manufactured or modified specifically for the buyer.

7 Complaints and Warranty

Complaints may be submitted via the online “Returns” form available on the seller’s website, via e-mail at info@ignisshop.com or in writing to the seller’s address.

The buyer is required to provide proof of purchase and describe the defect. To speed up processing, we recommend attaching photographs or videos showing the issue.

The seller shall decide on the complaint without undue delay, usually within 3 working days in more complex cases. Complaints shall be resolved no later than 30 days after submission unless agreed otherwise.

In the event of a justified warranty claim, the seller shall reimburse reasonably incurred costs associated with the complaint, including shipping costs for returning the claimed goods to the seller, up to a maximum of:

  • 40 EUR for shipping within the same continent,
  • 80 EUR for intercontinental shipping.

The buyer is required to contact the seller in advance and provide proof of shipping costs. The seller reserves the right to recommend a suitable carrier or shipping method.

The warranty period is 24 months unless stated otherwise for a specific product or required differently by applicable law.

The warranty does not cover normal wear and tear, mechanical damage caused by the buyer, improper use, incorrect maintenance, use contrary to instructions or intended purpose, damage caused by impacts, excessive force, heat, moisture, improper storage or unauthorized modifications.

8 Personal Data Protection

The seller processes personal data in accordance with the GDPR and applicable Czech legislation. Details are available in the separate Privacy Policy document published on the seller’s website.

9 Alternative Dispute Resolution

Consumers may use the Czech Trade Inspection Authority (ČOI) for out-of-court dispute resolution: www.coi.cz.

10 Governing Law and Jurisdiction

Contractual relations between the seller and the buyer are governed by the laws of the Czech Republic.

This does not affect mandatory consumer rights under the laws of the country where the consumer has their habitual residence.

Any disputes shall be resolved by the competent courts of the Czech Republic unless mandatory law provides otherwise.

11 Final Provisions

These Terms and Conditions are published on www.ignisshop.com and are valid in the wording effective on the date the order is submitted by the buyer.

The seller reserves the right to amend these Terms and Conditions unilaterally. The new version becomes effective upon publication, but not earlier than 14 days after publication unless stated otherwise.

The Complaints Procedure and Privacy Policy form an integral part of these Terms and Conditions.
